Bad day for justice

Bad day for justice: Jayalalithaa may not be guilty, but the judicial system is

by May 11, 2015
The Karnataka High Court's acquittal of J Jayalalithaa, former and future Chief Minister of Tamil Nadu, of all charges of corruption today (11 May) is actually an indictment of our higher and lower judiciary. That a case which painstakingly wound its way through the courts for 18 long years can be junked by a high court less than eight months after a conviction tells us how badly our lower and superior courts may be working. The delivery of justice is patchy, and big-ticket corruption involving the high and mighty is being treated with kid gloves.

Jayalalithaa was convicted and sentenced to a four-year jail term by special judge John Michael D'Cunha on 27 September last year. She spent a few days in jail after her conviction for crimes for which Judge D'Cunha had fined her a massive Rs 100 crore and barred her from holding elective office for 10 years.

The Karnataka High Court declined to set aside her conviction or give her bail 10 days later, saying corruption amounted to a “violation of human rights" and should be treated seriously. However, the Supreme Court held that she could be given bail - and she was out 21 days after her conviction. The Supreme Court also imposed conditions for her release. Among them: her lawyers would not adopt delaying tactics, and her appeal should be filed within two months.

High profile lawyers can clearly make a difference. Jaya had Fali Nariman arguing her case. Last week, Salman Khan got his bail practically without going to jail even after he was convicted for running over some payment dwellers in a drunken state 13 years ago. His lawyer was ready with his appeal even before the judgment was out.

On the other hand, Lalu Prasad got bail nearly two-and-a-half months after his conviction in September 2013 along with 44 others in the fodder scam - roughly a year before Jayalalithaa was convicted in the disproportionate assets case.

Given this background, it appears as if the higher courts do not have any kind of standard policy on how to deal with bail when someone is under trial, or when they get convicted in the lower courts.

As Supreme Court lawyer Rajeev Dhavan wrote in Mail Today soon after Jaya's bail last year: “Bail for as many is good, but applying it differentially is not. We do not have clear principles to guide bail decisions - especially in post-conviction cases, where judges look at the crime and behave totally with subjective arbitrariness against the poor. “

What this implies is that the courts are substantially influenced by both the power quotient of the convict or undertrial and the kind of legal representation he or she manages to put up.

This is hardly a good advertisement for the independence of the higher courts, including the Supreme Court, which is now hearing an appeal against the National Judicial Appointments Commission (NJAC) - a constitutional amendment passed by parliament with an overwhelming majority and 20 state legislatures. The argument that the NJAC will impact judicial independence loses potency when the higher courts can behave so arbitrarily when dealing with the cases of powerful people or politicians. Independence surely is not just about how judges are selected.

Nothing illustrates this point more than the kind of gratuitous comments made by the Supreme Court in the matter of Manmohan Singh's role in delaying A Raja's prosecution in the 2G scam. A petitioner had sought the PM's permission to prosecute Raja, but Manmohan Singh simply sat on his request. But when the Supreme Court decided that waiting for more than a year was unfair to the petitioner, it criticised not Manmohan Singh but his officials.

Pratap Bhanu Mehta quotes from the Supreme Court judgment in his Indian Express column of 2012 to imply how the court also gets swayed by the personality involved. The judgment said: “Unfortunately, those who were expected to give proper advice to Respondent No 1 (Manmohan Singh) and place the full facts and legal position before him failed to do so. We have no doubt that if Respondent No 1 had been appraised (sic) of the true factual and legal position regarding the representation made by the appellant (Subramanian Swamy), he would surely have taken appropriate decision and would not have allowed the matter to linger for a period of more than one year.”

Mehta asked: “How could anyone determine what someone else would without a doubt have done in the future? A supposition about character, not a consideration of official responsibility, is the ground for exoneration.”

One has to read the Karnataka High Court's full order in the Jayalalithaa appeal to figure out why it acquitted her when the special judge was so convinced about her guilt as to order strong punishment.

But two things are clear:

Whatever the merits of Jayalalithaa's appeal, her acquittal of all charges will demoralise the lower judiciary like nothing else. In future, few judges will bother to try hard to convict the powerful if this is what their efforts will result in.

Secondly, the speed of her acquittal stands in sharp contrast to the dilatory tactics adopted during the process of trial. This is a serious indictment of our justice system.

It is not about Jayalalithaa anymore. But we certainly have to hold the justice system guilty.

Mukesh Ambani’s son allegedly kills 2 in a car accident

Mukesh Ambani’s son allegedly kills 2 in a car accident. Media blacks out the news #WTFnews

http://www.kractivist.org/-ashton-martin-crash-open-letter-to-justice-markandey-katju-press-council-of-india/

Is Mukesh Ambani and family above the law? His son, Akash Ambani, allegedly kills two with his Aston Martin car running over them fully drunk.

Arnab Goswami; Rajdeep Sardesi and Barkha Dutt shamelessly blank out news! How can they when their boss’s son is allegedly involved? Neither is Kejriwal’s AAP or Anna’s India Against Corruption raking up the issue. Or for that fact, the Congress, the BJP or another political party in the country.
Zee News and DNA carried the news but it was deleted later but Google Search still carries their headlines and readers comments.  A Reliance employee now media reports apparently paid to own up the accident.
“A Reliance spokesman said a chauffeur was at the wheel and that the car was on a routine maintenance spin early on Sunday as it had not been used the previous day.. But one of the occupants of a car hit by the speeding Aston Martin told Mirror that she saw a young man in the driving seat and that he didn’t look like a chauffeur.. Bansilal Joshi, 55, a Reliance driver, presented himself at the Gamdevi police station, nearly 12 hours after the accident that left two other cars — an Audi and a Hyundai Elantra — badly smashed and eight people injured. He claimed responsibility for the crash..”

Mukesh Ambani might own the mass media but he doesn’t own social media.Join the campaign. Retweet and republish this news. Force mass media to carry the news and seek justice for the victims.
(Arunbha Sakia in Newslaundry) An Aston Martin Rapide – “a four-door high-performance sport saloon” -rammed into two cars late Saturday night, December 7, 2013 at Peddar Road in Mumbai, transforming itself from a Rs 3.5 crore-worth luxury sports car into ugly metal scrap. What has followed since has ranged from subtle innuendos to outright allegations against some of the most powerful and rich of Mumbai – and India.
A black Aston Martin Rapide (MH-O1-BK99) – driven at a very high speed according to eyewitnesses – rammed into an Audi (MH14-DN-6666) from behind as reported here. As a result of the impact, the Audi, driven by Foram Ruparel, a resident of Ghatkopar area, jumped the divider on the road and hit a private bus coming from the opposite direction. The Aston Martin, then hit a Hyundai Elantra belonging to Vikram Mishra. In the ensuing chaos, the driver of the Aston Martin managed to flee in one of the two SUVs which were trailing it. A hit-and-run case like this is pretty routine nowadays in Delhi and Mumbai.
However, what is not routine – and has been very conveniently overlooked by many in the media – was the fact that the Aston Martin was registered in the name of Reliance Ports and Terminals Limited which is owned by Mukesh Ambani.
Foram Ruparel, who was driving the Audi, lodged a complaint. Bansilal Joshi, 55, a driver employed with Reliance, presented himself at the Gamdevi police station on Sunday afternoon – December 8, 2013 – and accepted responsibility for the accident. This was almost 12 hours after the accident. However, as word spread, witnesses have started popping up with their version of events. A version of events, which makes this entire episode seem uncannily similar to the plot of Aravind Adiga’s The White Tiger where the protagonist, Balram, who works as a driver for a rich family, is made to own up to a very similar car accident his boss’s wife is involved in.
One of the occupants of a car hit by the speeding Aston Martin was quoted byMumbai Mirror – one of the very few media outlets to have covered the story in detail – as saying that she saw a young man in the driver’s seat. Another witness, not willing to be named, told Newslaundry that the person helped out of the Aston Martin after it finally came to a standstill
“was a young guy and not a moustached old man as everyone is being made to believe”.
In a telephonic conversation with Newslaundry, Varish Mishra, who was in the Elantra which was pulverised in the accident and which had a pregnant lady as one of its occupants said, “the Aston Martin continued to travel on three wheels for a long time and came to a halt more than 400 metres away from the original spot of accident, so you can imagine its speed”.
The media’s rather cautious and measured approach to the story, particularly in light of its aggressive coverage of other recent hit and run cases, is difficult not to notice. Hindustan Times’ report on the accident says that the driver worked for a “private firm” and never once mentions the car’s Reliance affiliation. The Times of India which published a story on December 9, 2013 with the headline –
“Reliance employee takes responsibility for accident involving Aston Martin” has removed the report from its website without any corrigendum. While Google still contains the link to the story, clicking on it leads to a dead link. On the evening on December 11, 2013, TOI published an edited version of the same report on its site without any mention of Reliance, choosing to call it “a national-level firm”.
We tried contacting TOI for an explanation for this editorial decision, but received no response. Times Now, which is based out of Mumbai, has totally ignored the story as well. DNA has also removed their news report on the incident.
We SMSed Rajdeep Sardesai, Editor-in-Chief, CNN-IBN on December 11, 2013 to ask why the channel had not yet reported on the incident. He informed us that they would be carrying the report that evening. The report was also carried on December 11, 2013 at 7.30pm on www.ibnlive.com. Reliance Group has investments in Network 18.
The facts as reported in the news are as follows. Reliance Industries has released a statement that the driver was out at 1.30 a.m. all by himself for a test run. The Aston Martin which was on a test drive, manned by a driver, was trailed by two SUVs – one of which whisked the driver away after the accident.
Eyewitnesses claim to have seen a young, clean-shaven, portly man being helped out of the damaged Aston Martin. The man who presented himself in the police station is 55 years old and has a moustache. The only resemblance he has to the eyewitness’ description of the fleeing driver is his hefty build.
The Mumbai Police has been trying to gather forensic evidence – which will be a difficult task, considering more than five people handled the car after the accident – and hasn’t made any arrests. What is curious is that most media houses have chosen not to report on the incident and why the ones that did do so, have removed the reports since.
Dear Sir!,
This story of a Reliance Ashton Martin Rapide car crash appears to be a classic case study of confirming the PUCL assertion. Accordingly the Press Council has to institute an independent enquiry to ascertain into the reason why these articles have been deleted without a formal retraction by such media agencies viz. to determine what kind of pressures led to these deletion
– was it the inducement of money
– was it political pressure
– was it the effect of both – inducement of money and political pressure

Salman's bail

A shrewd lawyer saves a tainted actor

A shrewd lawyer saves a tainted actor

In a huge relief to actor Salman Khan, the Bombay HC on Friday suspended his 5-year sentence in the 2002 hit-and-run case. The former Solicitor General of India and one of the top most lawyers of India, Harish Salve landed from Delhi to get Salman Khan a bail. What's Salve's history?
To begin with, Harish Salve was the counsel for infamous Italian Marines who killed Kerala fishermen in Feb 2012. The marines left India- never to return.

However, lets return to his latest case - Salman's hit and run.
What happens when a rich man that too actor drunk with his power kills innocent people and give the others life long disabilities. Salman was granted bail pending his appeal against conviction, his liberty thus remains uncurtailed.  The judge Abhay M Thipsay directed Salman Khan to surrender before the trial court and furnish a fresh bail bond of Rs.30,000.

The former Solicitor General of India and one of the top most lawyers of India, Harish Salve himself, landed from Delhi to get Salman Khan a bail.
This is India where personality cult is so strong that people can not tolerate justice if it is against a famous leader or an actor. It has been shown in the spat of social media messages. Justice is ridiculed when lawyers like Salve come to rescue of killers. He will definitely support Salman Khan as killing a road side home less person is not a big deal for these people. Salve, who is believed to take around 35 lakh per hearing, saved Salman Khan and got bail with in 10 minutes.

Does the law apply to Harish Salve's Bentley?

The most vicious fact of this case is that Salve himself has been involved in a road accident that killed an innocent person. Barely any media group highlighted this news. The accident took place in May 2014. Harish Salve’s car was involved in an accident at the Rajpath-Mansingh Road crossing leaving the driver of the other vehicle, Mr. Joginder, seriously injured.
Mr. Joginder was admitted in the intensive care unit (ICU) at Dr Ram Manohar Lohia Hospital after the accident.
Joginder was an employee of the Le Meridien hotel. It is to be noted that Salve himself did not approach police rather it was an unknown caller who informed police about the accident. Joginder died on the day of accident itself in the ICU of Dr Ram Manohar Lohia hospital. Here is the shocking part: On Salve’s instructions, a case of rash and negligent driving was filed against Joginder at the Parliament Street police station based on the complaint filed by Salve’s driver Arvind Pande. After all he was the driver of a shrewd lawyer.
Dramtically, later, Salve withdrew the FIR. The poor family of the dead person hails from Haridwar. They wanted to file a case against Salve.
But how can a poor family fight a legal battle against the “The Harish Salve”?

The undisputed facts

What we know for sure is that a man died in a car accident involving two cars - A Wagon R (driven by the man who died) and a Bentley (owned by Mr. Harish Salve).  Does the law not require a police investigation into culpability after registration of an FIR?No police investigation was done in this case, even when a poor man died as a result of the accident. Why did no legal proceeding took place against Mr. Salve? Did law take its course in Salve’s accident case? No one knows, or cares.

Shrewd helps the tainted

Now, the same man has helped actor Salman Khan in a similar case to go scot free even after he is convicted in the sessions court.
This is the sorry state of our system where money and muscle power does play a role.
Unfortunately, many fanboys are so emotional that they are prepared forgive crimes if committed by stars. People can stop having food in their support. Social media is used to insult people living on streets.
It is just the weak and poor who suffer. People like Salman commit crimes, kill endangered animals, beat the women they claim to love and then hire lawyers like Salve who use their own personal experiences and clout in saving the criminals.

China Must Be Defeated, The TPP Is Essential to Undermining China

Council on Foreign Relations’ Grand Strategy: China Must Be Defeated, The TPP Is Essential to Undermining China

Region: ,
china-us
Wall Street’s Council on Foreign Relations has issued a major report, alleging that China must be defeated because it threatens to become a bigger power in the world than the U.S.
This report, which is titled “Revising U.S. Grand Strategy Toward China,” is introduced by Richard Haass, the CFR’s President, who affirms the report’s view that, “no relationship will matter more when it comes to defining the twenty-first century than the one between the United States and China.” He says that the report he is publishing argues that “strategic rivalry is highly likely if not inevitable between the existing major power of the day and the principal rising power.” Haass says that the authors “also argue that China has not evolved into the ‘responsible stakeholder’ that many in the United States hoped it would.” In other words: “cooperation” with China will probably need to become replaced by, as the report’s authors put it, “intense U.S.-China strategic competition.
Haass gives this report his personal imprimatur by saying that it “deserves to become an important part of the debate about U.S. foreign policy and the pivotal U.S.-China relationship.” He acknowledges that some people won’t agree with the views it expresses.
The report itself then opens by saying: “Since its founding, the United States has consistently pursued a grand strategy focused on acquiring and maintaining preeminent power over various rivals, first on the North American continent, then in the Western hemisphere, and finally globally.” It praises “the American victory in the Cold War.” It then lavishes praise on America’s imperialistic dominance:
“The Department of Defense during the George H.W. Bush administration presciently contended that its ‘strategy must now refocus on precluding the emergence of any potential future global competitor’—thereby consciously pursuing the strategy of primacy that the United States successfully employed to outlast the Soviet Union.”
The rest of the report is likewise concerned with the international dominance of America’s aristocracy or the people who control this country’s international corporations, rather than with the welfare of the public or as the U.S. Constitution described the objective of the American Government: “the general welfare.”
The Preamble, or sovereignty clause, in the Constitution, presented that goal in this broader context:
”in order to form a more perfect union, establish justice, insure domestic tranquility, provide for the common defense, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity.”
The Council on Foreign Relations, as a representative of Wall Street, is concerned only with the dominance of America’s aristocracy. Their new report, about “Revising U.S. Grand Strategy Toward China,” is like a declaration of war by America’s aristocracy, against China’s aristocracy. This report has no relationship to the U.S. Constitution, though it advises that the U.S. Government pursue this “Grand Strategy Toward China” irrespective of whether doing that would even be consistent with the U.S. Constitution’s Preamble.
The report repeats in many different contexts the basic theme, that China threatens “hegemonic” dominance in Asia. For example:
“China’s sustained economic success over the past thirty-odd years has enabled it to aggregate formidable power, making it the nation most capable of dominating the Asian continent and thus undermining the traditional U.S. geopolitical objective of ensuring that this arena remains free of hegemonic control.”
The report never allows the matter of America’s “hegemonic control” to be even raised. Thus, “hegemony” is presumed to be evil and to be something that the U.S. must block other nations from having, because there is a “traditional U.S. geopolitical objective of ensuring that this arena remains free of hegemonic control.” In other words: the U.S. isn’t being “hegemonic” by defeating aspiring hegemons. The report offers no term to refer to “hegemony” that’s being practiced by the U.S.
The report presents China as being supremacist, such as what (to quote again from the report) “historian Wang Gungwu has described as a ‘principle of superiority’ underwriting Beijing’s ‘long-hallowed tradition of treating foreign countries as all alike but unequal and inferior to China.’ Consistent with this principle, Henry Kissinger, describing the traditional sinocentric system, has correctly noted that China ‘considered itself, in a sense, the sole sovereign government of the world.’” America’s own ‘Manifest Destiny’ or right to regional (if not global) supremacy is not discussed, because supremacism is attributed only to the aristocracies in other countries, not to the aristocracy in this country.
Rather than the “general welfare,” this document emphasizes “U.S. Vital National Interests,” which are the interests of America’s aristocrats, the owners of America’s large international corporations.
This report urges:
“The United States should invest in defense capabilities and capacity specifically to defeat China’s emerging anti-access capabilities and permit successful U.S. power projection even against concerted opposition from Beijing. … Congress should remove sequestration caps and substantially increase the U.S. defense budget.”
In other words: the Government should spiral upward the U.S. debt even more vertically (which is good for Wall Street), and, in order to enable the increased ‘defense’ expenditures, only ‘defense’ expenditures should be freed from spending-caps. Forget the public, serve the owners of ‘defense’ firms and of the large international corporations who rely on the U.S. military to protect their property abroad.
The report says that China would have no reason to object to such policies: “There is no reason why a China that did not seek to overturn the balance of power in Asia should object to the policy prescriptions contained in this report.” Only a “hegemonic” China (such as the report incessantly alleges to exist, while the U.S. itself is not ‘hegemonic’) would object; and, therefore, the U.S. should ignore China’s objections, because they would be, by definition ‘hegemonic.’ Or, in other words: God is on our side, not on theirs.
“Washington simply cannot have it both ways—to accommodate Chinese concerns regarding U.S. power projection into Asia through ’strategic reassurance’ and at the same time to promote and defend U.S. vital national interests in this vast region.”
The authors make clear that U.S. President Obama is not sufficiently hostile toward China: “All signs suggest that President Obama and his senior colleagues have a profoundly different and much more benign diagnosis of China’s strategic objectives in Asia than do we.”
Furthermore, the report ends by portraying Obama as weak on the anti-China front: “Many of these omissions in U.S. policy would seem to stem from an administration worried that such actions would offend Beijing and therefore damage the possibility of enduring strategic cooperation between the two nations, thus the dominating emphasis on cooperation. That self-defeating preoccupation by the United States based on a long-term goal of U.S.-China strategic partnership that cannot be accomplished in the foreseeable future should end.”
The report’s “Recommendations for U.S. Grand Strategy Toward China” urges Congress to “Deliver on the Trans-Pacific Partnership, … as a geoeconomic answer to growing Chinese economic power and geopolitical coercion in Asia,” but it fails to mention that the Obama Administration has already embodied the authors’ viewpoint and objectives in the TPP, which Obama created, and which cuts China out; it could hardly be a better exemplar of their agenda. The authors, in fact, state the exact opposite: that Obama’s objective in his TPP has instead been merely “as a shot in the arm of a dying Doha Round at the World Trade Organization (WTO).” They even ignore that Obama had cut China out of his proposed TPP.
“Russia’s aggression toward former Soviet states unnerves capitals in Europe, while China’s economic rise and military reach worries its neighbors. From Brazil to India, rising middle classes compete with us, and governments seek a greater say in global forums.”
He was saying that these future military leaders will be using guns and bombs to enforce America’s economic dominance. This is the same thing that the CFR report is saying.
His speech also asserted:
“I believe in American exceptionalism with every fiber of my being. … The United States is and remains the one indispensable nation. That has been true for the century passed and it will be true for the century to come.”
(That even resembles: “Henry Kissinger, describing the traditional sinocentric system, has correctly noted that China ‘considered itself, in a sense, the sole sovereign government of the world.’” Obama is, in a sense, saying that America is the “sole sovereign government in the world.”)
He made clear that China is “dispensable,” and that the U.S. must stay on top.
However, there is a difference between Obama and the CFR on one important thing: Obama sees Russia as the chief country over which the U.S. must dominate militarily, and China as the chief country to dominate economically. But in that regard, he is actually old-line Republican, just like his 2012 opponent Mitt Romney is. The only difference from Romney on that is: Obama wasn’t so foolish as to acknowledge publicly a belief that he shared with Romney but already knew was an unpopular position to take in the general election.
Furthermore, whereas the CFR report ignores the public’s welfare, Obama does give lip-service to that as being a matter of concern (just as he gave lip-service to opposing Romney’s assertion that Russia is “our number one geopolitical foe”). After all, he is a ‘Democrat,’ and the authors of the CFR report write instead as if they were presenting a Republican Party campaign document. No ‘Democrat’ can be far-enough to the political right to satisfy Republican operatives. The pretense that they care about the public is therefore far less, because the Republican Party is far more open about its support of, by, and for, the super-rich. Mitt Romney wasn’t the only Republican who had contempt for the lower 47%. But even he tried to deny that he had meant it. In that sense, the CFR’s report is a Republican document, one which, quite simply, doesn’t offer the public the lip-service that Obama does (and which he politically must, in order to retain support even within his own party).
Perhaps on account of the CFR report’s condemning Obama for not being sufficiently right-wing — even though he is actually a conservative Republican on all but social issues (where China policy isn’t particularly relevant) — the report has received no mention in the mainstream press, ever since it was originally issued, back in March of this year. For whatever reason, America’s ‘news’ media ignored the report, notwithstanding its importance as an expression of old-style imperialistic thinking that comes from what many consider to be the prime foreign-affairs mouthpiece of America’s aristocracy — the CFR. The report’s first coverage was on 2 May 2015 at the World Socialist Web Site, which briefly paraphrased it but didn’t even link to it. Then, two days later, Stephen Lendman wrote about the CFR report. He briefly paraphrased it and passionately condemned it. He did link to the report. But he didn’t note the WSWS article, which had first informed the public of the CFR report’s existence — an existence which, until the WSWS article, all of America’s ‘press’ had simply ignored.
The present article is the first one to quote the CFR report, instead of merely to paraphrase and attack it. The quotations that were selected are ones presenting the report’s main points, so that readers here can see these points stated as they were written, rather than merely as I have interpreted them. My interpretation is in addition to, rather than a substitute for, what the report itself says.

The ISIL is in Ukraine: America’s “Agents of Chaos” Unleashed in Eurasia

The ISIL is in Ukraine: America’s “Agents of Chaos” Unleashed in Eurasia

Agents of chaos
Is the so-called Islamic State in Iraq and Syria (ISIS)/Islamic State in Iraq and the Levant (ISIL) / Islamic State (IS) / Al-Dawlah Al-Islamiyah fe Al-Iraq wa Al-Sham (DAISH/DAESH) active in post-EuroMaidan Ukraine? The answer is not exact. In other words, the answer is both yes and no.
Then again, what is the ISIS/ISIL/IS/DAISH/DAESH? It is a loosely knit band of militias, just like its predecessor Al-Qaeda. Included in its network are groups from the Caucasus, which have been fighting in Syria and Iraq. Now they are in Ukraine and using it as a steppingstone into Europe.
The Agents of Chaos and the War for Eurasia
The conflicts in Ukraine, Syria, Iraq, Libya, and Yemen are all fronts in a multi-dimensional war being waged by the US and its allies. This multi-dimensional war aims to encircle Eurasia. China, Iran, and Russia are the main targets.
The US also has an order of operations with which to takeout these countries. Iran is first, followed by Russia, with China as the last part of the Eurasian set comprised of this «Eurasian Triple Entente.» It is no coincidence that the conflicts in Ukraine, Syria, Iraq, Libya, and Yemen are near the borders of Iran and Russia, because Tehran and Moscow are the nearer term targets of Washington.
In the same vein as the interlinked nature of the conflicts in Ukraine, Syria, Iraq, Libya, and Yemen, there is also a connection between the violent, racist, xenophobic, and sectarian forces that have been unleashed as «agents of chaos.» It is no mere coincidence that Newsweek had a headline saying «Ukrainian Nationalist Volunteers Committing ‘ISIS-Style’ War Crimes» on September 10, 2014. [1] Whether they know it or not, these deviant forces, whether they are the ultra-nationalist Pravy Sektor militias in Ukraine or the head-cutting gangs of Al-Nusra and the ISIS/ISIL/IS/DAISH/DAESH in Syria and Iraq, all serve one master. These agents of chaos are unleashing different waves of constructive chaos to prevent Eurasian integration and a world order that is free of US dictates.
The «constructive chaos» that is being unleashed in Eurasia will eventually wreck havoc in India. If New Delhi thinks that it will be left alone, it is foolishly mistaken. The same agents of chaos will plague it as well. It too is a target like China, Iran, and Russia.
Strange Alliances: Alliance between the ISIL/DAESH and Ukraine’s Ultra-Nationalists?
It should not come as a surprise that the different agents of chaos are loosely aligned. They serve the same master and they have the same enemies, one of which is the Russian Federation.
It is in this context that Marcin Mamon has reported about the ISIS/ISIL/IS/DAISH/DAESH connection in Ukraine. He even explains that some of the fighters from the Caucasus feel that they have a debt to Ukrainians like Oleksandr Muzychko. [2]
Mamon is a Polish documentary filmmaker who has produced a number of documentaries about Chechnya, such as The Smell of Paradise with Mariusz Pilis in 2005, for the British Broadcasting Corporation’s Storyville program. He is also openly sympathetic to the cause of the Chechen separatists against Russia in the North Caucasus.
Mamon’s travels to Afghanistan and his interaction with Chechen separatist fighters have resulted in the Polish filmmaker having contacts with the ISIS/ISIL/IS/DAISH/DAESH inside Syria and Turkey. This extraordinarily led him down a new path to Ukraine.
«I didn’t even know, at that point, whom I was meeting. I knew only that Khalid, my contact in Turkey with the Islamic State [ISIS/ISIL/IS/DAISH/DAESH], had told me his ‘brothers’ were in Ukraine, and I could trust them», he writes about his meeting in a «potholed street in Kiev, east of the Dnieper River, in an area known as the Left Bank.» [3] In an earlier article Mamon explains that these so-called «‘brothers’ are members of ISIS and other underground Islamic organizations» who «are on every continent, and in almost every country, and now they are in Ukraine, too.» [4] He also explains that «Khalid, who uses a pseudonym, leads the Islamic State’s underground branch in Istanbul. He came from Syria to help control the flood of volunteers arriving in Turkey from all over the world, wanting to join the global jihad. Now, he wanted to put me in touch with Ruslan, a ‘brother’ fighting with Muslims in Ukraine». [5]
Ukrainian ultra-nationalists like Muzychko also became so-called «brothers» and accepted into this network. Mamon explains that the Chechen fighters accepted him «even though he never converted to Islam» and that «Muzyczko, along with other Ukrainian volunteers, joined Chechen fighters and took part in the first Chechen war against Russia» where they «commanded a branch of Ukrainian volunteers, called ‘Viking,’ which fought under famed Chechen militant leader Shamil Basayev.» [6]
Why is the ISIL manning Private Battalions in Ukraine?
What does it say when Chechen separatists and the transnational network of so-called «brothers» tied to the ISIS/ISIL/IS/DAISH/DAESH are being recruited or used to fill the ranks of private militias being using by Ukrainian oligarchs? This is a very important question. It also clearly demonstrates how these elements are agents of chaos.
Marcin Mamon travelled to Ukraine to meet the Chechen fighter Isa Munayev. Munayev’s background is explained thus: «Even before he arrived in Ukraine, Munayev was well-known. He fought against Russian forces in both Chechen wars; in the second, he was the commander of the war in Grozny. After the Chechen capital was captured by Russian forces between 1999 and 2000, Munayev and his men took refuge in the mountains. He fought from there until 2005, when he was seriously injured and went to Europe for treatment. Munayev lived in Denmark until 2014. Then war broke out in Ukraine, and he decided it was time to fight the Russians again.» [7]
The above is an important passage, because it illustrates how the US and EU have supported militants fighting against Russia. In the US and the EU, the refuge that Denmark gave Isa Munayev is not questioned, whereas the allegations leveled against Moscow for supporting the soldiers of the Donetsk People’s Republic and Lugansk People’s Republic are seen as criminal. Why the double standards? Why is it okay for the US, EU, and NATO to support separatist movements and militias in other parts of the world, but criticized and forbidden for other countries to do the same?
«An older man in a leather jacket introduced me to Munayev. ‘Our good brother Khalid recommended this man,’ the man said. (Khalid is today one of the most important leaders of the Islamic State. Khalid and Munayev knew each other from years spent fighting together in Chechnya),» Marcin Mamon explains about the connections between the Chechen separatists and ISIS/ISIL/IS/Daish/Daesh. [8]
Munayev has come to Ukraine to establish «one of what would become several dozen private battalions that sprang up to fight on the side of the Ukrainian government, operating separately from the military.» [9] His militia was named the Dzhokhar Dudayev battalion, which was named after the separatist president of Chechnya.
